1. Introduction

Welcome to Alwaysaroundme.com (“Website”). By accessing or using our Website, you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use our Website.

2. Definitions

• “User” refers to anyone who accesses or uses the Website.
• “Member” refers to Users who have registered and paid for a subscription to access the Live Lounges.
• “Live Lounges” refers to the feature of the Website where Members can schedule messages in video, pictures, and text to be delivered to loved ones after they have passed on.
• “Content” refers to any text, video, images, or other material that Users or Members upload, post, or otherwise make available on the Website.
• “Ranking System” refers to the system used to rank Users based on their activity and engagement on the Website.
• “Points System” refers to the system where Users earn points for making regular posts and participating in other activities on the Website.

3. Eligibility

By using the Website, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under the age of 18, you must have permission from a parent or guardian to join the Website. Users under the age of 16 cannot partake in the lottery but can still subscribe to the Tier 3 membership. If you are using the Website on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4. Account Registration

To access certain features of the Website, including the Live Lounges, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete. Accounts can be provided with a verified tick icon, but full verification must be provided.

5. Membership and Subscription

5.1 Membership Tiers The Website offers three tiers of membership subscriptions:

• 1st Tier (Free Membership): Limited access to the site with an allocation of up to 2 video uploads per month.
• 2nd Tier (Standard Membership): Full access to the site with an allocation of up to 8 video uploads per month.
• 3rd Tier (Premium Membership): Full access to the site with an allocation of up to 20 video uploads per month. Premium Members are also entered into a monthly lottery as described in section 5.3.

5.2 Payment You agree to pay all applicable fees related to your use of the Live Lounges in accordance with the billing terms in effect at the time of payment. All fees are non-refundable except as required by law.

5.3 Monthly Lottery for Premium Members

• Lottery Pool: £1 from each Premium Member’s payment will go into the prize fund.
• Prize Fund Allocation: 60% of the lottery pool will be awarded as the prize, 20% will be donated to a charity chosen as described below, 10% will fund the site’s Help Lines and counselling services, and 10% will be used for site upkeep and maintenance.
• Charity Selection: The monthly site leader, based on points gained for site activity, will select the charity to receive the 20% share. This individual will choose from three charities that have been pre-selected by the community.

6. Ranking and Points System

6.1 Ranking System The Website includes a ranking system where Users are ranked based on their activity and engagement. Higher rankings can provide additional benefits and recognition within the community.

6.2 Points System Users can earn points by making regular posts and participating in other activities on the Website. These points contribute to the User’s rank and may also unlock additional features or rewards. Points can be used to purchase items available on the Website. This feature is available only to paying Members who have made a minimum of six months of payments. Points will be deducted from their accounts to reflect the purchases.

7. Content and Conduct

7.1 User Content You retain ownership of any Content you upload, post, or otherwise make available on the Website. By making Content available on the Website, you grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, modify, distribute, and display such Content in connection with the operation of the Website.

7.2 Prohibited Conduct You agree not to engage in any of the following prohibited activities:

• Violating any applicable law or regulation.
• Posting any Content that is illegal, offensive, defamatory, or infringes on the rights of others.
• Attempting to interfere with the security or proper functioning of the Website.
• Using the Website to transmit any unsolicited or unauthorized advertising or spam.
• Engaging in self-advertisement without the written consent of Alwaysaroundme.com. Violation of this policy will result in the immediate termination of membership and the removal of all content associated with the offending account.

8. Privacy and Data Protection

8.1 Data Collection Alwaysaroundme.com does not track or collect any personal data from Users beyond what is necessary for account registration and operation of the Website.

8.2 Data Use We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. The Website is funded solely by membership subscriptions, affiliate links, and donations.

9. Special Access for Terminally Ill Members

Members diagnosed with a terminal illness can receive full access to the site with unlimited video uploads into the Live Lounges. Full proof of diagnosis must be provided to qualify for this access.

10. Termination

We reserve the right to terminate or suspend your account and access to the Website at our sole discretion, without notice and liability, for conduct that we believe violates these Terms or is harmful to other Users or the Website.

11. Privacy Policy

Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Website, you agree to the terms of the Privacy Policy.

12. Disclaimer of Warranties

The Website is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Website will be uninterrupted or error-free.
